End-User License Agreement

These terms and conditions ("Terms", "Agreement") are an agreement between Breezer ("Breezer", "we", "us", or "our") and you ("User", "you", or "your"). This Agreement sets forth the general terms and conditions of your use of the Breezer mobile application and its services (collectively, the "App", "Mobile Application", or "Services").

By accessing or using the Services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing the Services. Please read this Agreement carefully before using the Services.

1. Scope of Service

This Agreement applies only to your use of the Breezer App and Services. Breezer provides tools to track your snus consumption, set personalized limits, analyze usage patterns, and connect with friends to share progress. The App relies on user-provided data and does not include any sensors, medical advice, or external monitoring services.

You agree to use the Services in compliance with this Agreement and all applicable laws. Breezer is not responsible for user-provided data, including its accuracy, completeness, or implications.

2. Disclaimer: No Medical Advice

Breezer is not a healthcare provider, and the Services are not intended to diagnose, treat, cure, or prevent any medical condition. All data and insights provided by the App are for informational and tracking purposes only. You should consult a qualified healthcare provider for any medical concerns or advice related to your snus consumption or general health.

3. User Responsibility

You are solely responsible for:

Accurately entering your snus consumption data into the App.
Setting appropriate personal limits within the App.
Using the insights and statistics provided by the App responsibly.

Breezer is not liable for any health issues, financial implications, or other outcomes resulting from your use of the Services or decisions based on the data you input or the insights provided by the App.

4. Account Management and Security

By creating an account with Breezer, you represent and warrant the following:

You are at least 18 years old.
You have provided accurate and complete registration information.
You will maintain the confidentiality of your account credentials.

You are responsible for all activities that occur under your account. If you suspect unauthorized use, you must notify us immediately at breezer-app@gmail.com. Breezer will not be liable for any loss or damage arising from your failure to secure your account.

The following actions are strictly prohibited:

Sharing your account credentials with others.
Using another user's account without permission.
Exploiting the App’s features for unauthorized or illegal purposes.

5. Privacy Policy

Your use of the Services is governed by our Privacy Policy. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

6. Intellectual Property

All content, features, and functionality available through the Services are owned by Breezer and protected by applicable copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes.

You agree not to:

Copy, modify, or distribute any part of the App or its content without prior written consent from Breezer.
Reverse-engineer, decompile, or create derivative works based on the App.
Use the App for commercial purposes without authorization.

7. Modification of Terms

Breezer reserves the right to modify, update, or replace these Terms at any time. Changes will be effective immediately upon posting. It is your responsibility to review this Agreement periodically. Continued use of the Services after changes have been made constitutes your acceptance of the revised Terms.

8. Limitation of Liability

The Services are provided "as is" and "as available" without any warranties, express or implied. Breezer disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Breezer shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Services, including but not limited to:

Health issues or outcomes related to snus consumption.
Errors or inaccuracies in the data or insights provided by the App.
Unauthorized access to your account or data.

9. Indemnification

You agree to indemnify and hold harmless Breezer, its affiliates, employees, officers, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your:

Violation of this Agreement.
Use of the Services.
Misuse or unauthorized use of the App.

10. Termination of Service

Breezer reserves the right to suspend or terminate your account or access to the Services at any time, for any reason, including but not limited to:

Violation of this Agreement.
Unauthorized or harmful behavior.

Upon termination, your right to use the Services will immediately cease. Sections 2, 6, 8, and 9 of this Agreement will survive termination.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any disputes arising from or relating to this Agreement will be subject to the exclusive jurisdiction of the courts in Austria.
